billed for the remainder, and you agree to pay the bill within 10 days of receipt of bill. INT.____________

This Short Term Vacation Rental Agreement (STVRA) is made effective as of the effective date at the top of this lease,by and between Danny Box DBA BOX RENTALS, ("Owner"),and the "Transient Guest" as described at the top of this STVRA. 

The parties agree as follows:

NO SMOKING IS ALLOWED INSIDE ANY STRUCTURE NEAR ANY OPEN DOORS OR WINDOWS 

Smoking is permitted outside only with removal of all trash and ash. 

NOT IN THE POOL for properties with pools OR IN THE NATURAL BODY OF WATER (CANAL) for properties on the water.

Premises, Landlord, in consideration of the Rental payments provided in this Rental, 

Rents to Transient, Guest(s) a Two Bedroom, single family home with a pool ("The premises")

FURNISHINGS: The Rental of the premises includes the furnishings. 

Tenant shall return all such items at the end of the Rental (STVRA) term in good condition and in same location it was in upon arrival.

In as good as the condition at the beginning of the lease term, except for such deterioration that might result from normal use of furnishings.

ANY SOUND SHALL NOT BE PLAINLY AUDIBLE FOR A PERIOD OF ONE(1) MINUTE OR LONGER AT A DISTANCE OF TWENTY-FIVE(25) FT OR MORE WHEN MEASURED FROM THE SOURCE PROPERTY LINE BETWEEN THE HOURS OF 10:00PM & 7:00 AM DAILY AND AT A DISTANCE OF FIFTY (50)FT OR MORE WHEN MEASURED FROM THE SOURCE PROPERTY LINE BETWEEN  7:00 AM & 10:00 PM DAILY

PLEASE  REMEMBER SOUND TRAVELS ON THE WATER

BE MINDFUL YOU ARE IN A FAMILY NEIGHBOORHOOD AND ANY INFRACTIONS OF THIS WILL NOT BE TOLERATED

IF A COMPLAINT IS LODGED AND / OR THE OWNER, OWNERS RESPONSIBLE PARTY OR POLICE ARE CALLED OUT YOU WILL BE ASKED TO DEPART FROM THE HOME WITHOUT A REFUND REGARDLESS OF HOW LONG YOU STILL HAVE AVAILABLE IN THE RENTAL AND YOU UNDERSTAND INTS________

Parking there can not be more than ________________cars at the residence.

Parking can only be in designated areas as per Ordinances Parking DRAWING Will Be Emailed per the property you .

YOU WILL BE EXPECTED TO SIGN DATE AND RETURN ALONG WITH RENTAL AGREEMENT.

CANCELLATIONS & REFUNDS:

There is a $200.00 cancellation fee for all cancellations. There are no refunds of rental payments for cancellation less than 30 days prior to arrival. 

STORAGE: Landlord shall not be liable for loss of or damage to, stored items of tenant or tenants personal belongings.

TERMThe Rental term will begin at the "Short Term Rental Term Begins" Date described at the top of this lease and will terminate at the "Short Term Rental Ends (STVRA)" date described at the top of this (STVRA). Guest (Transient Occupant(s), in consideration of this STVRA , shall pay the "Total Amount Due" to the Owner as described at the top of this STVRA. 

Refer to the section on "Security Deposit" for additional information. This payment shall be paid in full and prior to Guest (Transient Occupant) taking possession of the Premises.

YOU ARE EXPECTED TO DEPART FROM THE RENTAL LEAVING THE HOME REASONABLY CLEAN EXCESSIVE CLEANING CHARGES MAY BE BILLED TO YOU.



HOLDOVER. If Guest (Transient Occupant ) maintains possessions of the Premises for any period after the termination of this agreement ("Holdover Period"). Guest ( Transient Occupant)shall pay Landlord a Short Term Rental payment for the Holdover Period based on the terms of the following STVRA Payments Paragraph. Such holdover shall constitute a day to day, week to week, or month to month extension of this STVRA.HOLDOVER SHORT TERM VACATION RENTAL PAYMENTS. Guest (Transient Occupant) shall pay to the Owner STVRA payments of $350.00 per day, $1800.00 per week, or $5000.00 per month, payable in advance on the first day of a daily, weekly, monthly holdover. HOLDOVER CAN NOT INTERFERE WITH ANOTHER RESERVATION THERE WILL BE NO HOLDOVER IF ANOTHER RESERVATION WAS BOOKED PRIOR TO THE END OF GUEST WISHING HOLD OVER. If holdover guest refuses to leave the authorities will enforce immediate removal of guests.

Unless prior written agreement by owner. SHORT TERMVACATION RENTAL payments shall be made either thru advertising web site or by direct payment to Owner. INT._________

NON-SUFFICIENT FUNDS. GUEST (Transient Occupant) shall be charged $100.00 for each check or payment that is in dispute or is returned to the owner for lack of sufficient funds. if original funds plus Fee is not paid within 14 days of demand any NSF Checks will be turned over to the proper authorities for prosecution.

POSSESSION: Guest (Transient occupant) shall be entitled to possession on the first day of the term of this STVRA, at 4:00PM in the afternoon, and shall yield possession on the last day of the term of this Agreement, at 10:00 AM in the morning, unless otherwise agreed by both parties in writing. INT_____________

USE OF PREMISES/ABSENCES. Guest (Transient Occupant) shall occupy and use the Premises as a dwelling unit.

KEYS. The Guest (Transient Occupant) will be given _____key to the premises, ____garage door opener if applicable, _______security clicker if applicable.



 If all keys, house openers and security devices are not returned at the end of the term then the Guest (Transient Occupant) will be charged a replacement for each item missing and to have the home rekeyed by a lock smith and security specialist.

LOCKOUT: If the Guest (Transient Occupant) becomes locked out of the premises, he must call the owner for directions.

MAINTENANCE: Owner shall have the responsibility to maintain the Premises in good repair at all times.

ACCESS BY THE Owneror By Responsible Property Rep TO PREMISES. Subject to Guest (Transient Occupant) consent (which shall not be unreasonably withheld), Owner shall have the right to enter the Premises to make inspections, provided necessary services. As provided by law, in the case of an emergency, Owner may enter the Premises without the Guest (Transient Occupant) consent.

PROPERTY INSURANCE: Owner and Guest (Transient Occupant) shall each be responsible to maintain appropriate insurance for their respective interests in the Premises and property located on Premises.

DANGEROUS MATERIALS: Guest (Transient Occupant) shall not keep or have on the premises any article or thing of dangerous,inflammable,or explosive character that might substantially increase the danger of fire on the Premises, or that might be considered hazardous by a responsible insurance company.

No Illegal substances or drugs will be brought to, made or kept any where on these premises at any time City Of Fort Lauderdale Police, DEA, Broward county Sheriffs office will be alerted in any suspicion arises while Guest (Transient Occupant) are at the premises or there guests.

DEFAULTS: Guest (Transient Occupant) shall be in default of this STVRA, if Guest (Transient Occupant) fails to fulfill any STVRA obligation or term by which Guest (Transient Occupant) is bound. Subject to any governing provisions of law to the contrary, if Guest (Transient Occupant) fails to cure any financial obligation within seven days ( or any other Obligation within seven days) after written notice of such default is provided by Owner to Guest (Transient Occupant) , Owner may take possession of the Premises without further notice, and without prejudicing Owners rights to damages. In the alternative, Owner may elect to cure an default and the cost of such action shall be added to Guest (Transient Occupant)’s financial Obligations under this STVRA, including reasonable attorney fees. Guest (Transient Occupant) shall pay all costs, damages, and expenses suffered by owner by reason of’Guest (Transient Occupant)s defaults. All sums of money or charges required to be paid by Guest (Transient Occupant) under this STVRA shall be additional rent, whether or not such sums or charges are designated as "additional rent".

For homes with a POOAND ALL EQUIPMENT IS FOR THE SOLE USE OF THE THE Guest (Transient Occupant) AND IS USED SOLEY AT YOUR OWN RISK AS PER POOL WAIVER. 

POOL SAFETY EQUIPMENT IS NOT TO BE USED UNLESS EMERGENCY ARISES AND MUST BE REPORTED TO OWNER AS SOON AS EMERGENCY ARISES INT_______________

Adults must supervise children in the pool area at all times.

NO GLASS ALLOWED IN OR AROUND POOL. INT______

DOCK AND ITS STRUCTURE AND EQUIPMENT IS FOR THE SOLE USE OF THE Guest (Transient Occupant) AND IS USED SOLEY AT YOUR OWN RISK AS PER DOCK WAIVER.



ALL DOCK SAFETY EQUIPMENT IS STRICTLY FOR USE IN AN EMERGENCY ONLY AND MUST BE REPORTED TO OWNER AS SOON AS IT IS USED INT_______________

 

 

HABITABILITY. If the condition changes so that the habitability and rental value of the Premises are adversely affected, Guest (Transient Occupant) shall promptly provide reasonable notice to Owner.

FORCE MAJESTURE: In the event of an "Act Of God", something resulting from floods, tornado's, earthquakes, hurricanes, lightening, storms, rising waters, etceteras, which renders the premises uninhabitable. Owner will not be held responsible for providing Guest (Transient Occupant) with temporary shelter.

ATTAINABILITY/SUBLETTING: Guest (Transient Occupant) may not assign or sublease any interest in the Premises.

 

Notices under this STVRA (SHORT TERM VACATION RENTAL AGGREEMNET) shall not be deemed valid unless given or served in writhing and forwarded by e-mail, mail, postage prepaid, addressed to the Owner and Guest (Transient Occupant) as described at the top of this STVRA. Such addresses may be changed from time to time by either party by providing notice as set forth above.

ENTIRE AGREEMENT/ AMENDMENT. This Short Term Vacation Rental Agreement contains the entire agreement of the parties and there are no other promises or conditions in any other agreement whether oral or written. This STVRA may be modified in writing, if the parties obligated under the amendment signs the writing.

LIABILITY: The Owners and Management cannot accept any liability for any loss of rental time due to travel problems, family crisis, flight delays, cancellations, terrorist acts, industrial disputes, weather related events including hurricanes, any events outside of our control, including any form of Force Majuro. The owners cannot accept any liability for failure of public supplies/ utilities such as water, as supplies, electricity, phone service, Internet service, cable service, gas suppliers, or of air conditioning supplies. Nor do we accept liability for the consequences of the actions or omissions of others that may supply or control main services, or any action taken in the vicinity of the property by any authority over which there is no control.

SEVER-ABILITY: If any portion of this STVRA shall be held invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this STVRAis invalid or unenforceable, but that limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

CUMULATIVE RIGHTS: The rights of the parties under this STVRA are cumulative, and shall not be construed as exclusive unless required by law.

GOVERNING LAW: This STVRA shall be construed in accordance with the Laws of Florida.

SUBORDINATION OF SHORT TERM VACVATION RENTAL AGREEMENT. This STVRA is subordinate to any mortgage that may exist, or may be given later by Owner, with respect to the Premises.

DAMAGES.

I/WE understand that I/WE will be charged for any damages that occur during my/OUR stay. And will pay any additional damage charges that my Deposit or PDP which ever is in place doesn't cover within 10 days after being billed for such. INT______

Waiver and release of liability. READ CAREFULLY. 

In consideration of Danny L Box Trust Danny L Box Trustee DBA(Box Rentals) furnishing services and/or equipment to enable me to participate in Docking, boating, fishing and swimming activities off of Dock, I/We agree as follows: 

I/ We fully understand and acknowledge that outdoor recreational activities have: (a) inherent risks, dangers and hazards; and such exist in my/ our use of the Dock and my/our participation in docking, boating, fishing and swimming activities; (b) my/our participation in such activities and/or use of such equipment may result in injury or illness including, but not limited to, bodily injury, disease, strains, fractures, partial or total paralysis, death or other ailments that could cause serious disability; (c) these risks and dangers may be caused by the negligence of the owners, employees, officers ,agents or volunteers of Danny L Box Trust Danny L Box Trustee DBA(Box Rentals) , the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes. 

Risks and dangers may arise from foreseeable or unforeseeable causes including, but not limited to, terrain, weather, wind, trail, water level, risks of falling off or drowning while on the dock, or along the seawall and such other risks, hazards and dangers that are integral to recreational activities that take place in a outdoor or recreational environment; and (d) by my/our participation in these activities and/or use of equipment, I/we hear by assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or part by the negligence or other conduct of the owners, agents, employees, officers, agents, or volunteers of . Danny L Box Trust Danny L Box Trustee DBA(Box Rentals) or by any other person. 

I,/we on behalf of myself, my personal representatives, and my heirs, hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Danny L Box Trust Danny L Box Trustee DBA(Box Rentals) owners, agents, officers, employees or volunteers from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of the Dock 

I/we specifically understand that I/we are releasing, discharging and waiving any claims or actions that I/we may have presently or in the future for the negligent acts or other conduct of the owners, agents, officers, employees or volunteers of Danny L Box Trust Danny L Box Trustee DBA(Box Rentals) 

I/we have read the above waiver and release and by signing it agree. That it is my/our intention to exempt and relieve from Danny L Box Trust Danny L Box Trustee DBA(Box Rentals) liability for personal injury, property damage or wrongful death caused by negligence or any other cause.
